DEPOSITS Back to top

New legislation “protecting deposits” and governing the way they are held came into effect on the 6th April 2007. For most individual Landlords there is essentially two options Insured Agent or Custodian, for Landlords with large portfolios of rental property a third option is available.
All Assured Shorthold Tenancies (AST’s) MUST protect the Tenant’s deposit by one or other of these options. The legislation is not retrospective and affects only AST’s in England and Wales that started after 6th April 2007 – it does not affect non Housing Act tenancies.

The three possible options are listed below.
  1. Custodian. The Landlord registers the deposit with the Custodian (Computershare Ltd) and gives the deposit to the Custodian. Strict administrative rules and timescales have to be complied with. The service is free to all parties and the Custodian will provide a free resolution service should there be a dispute at the end of the tenancy.
  2. Insured. The Deposit Solution Service (TDS). The Landlord or agent must initially register with the TDS (chargeable annually) and subsequently pay an insurance premium for each deposit registered but keeps the deposit in a client escrow account. The TDS offers a free dispute resolution service should it be needed.
  3. Also Insured. The Dispute Service (confusingly also known as the TDS). There is a substantial registration fee here between £800 and £1600 per annum and therefore this option will really only apply to agents and to Landlords with very large portfolio’s – typically in excess of 150 properties
